How Fiducia supports customer-branded experiences as a data processor and service provider.

This Privacy Policy describes Fiducia's role as a data processor/service provider. It supplements the privacy notice provided by the Customer whose experience you use.

1. Introduction

Fiducia | AI, Inc. (“Fiducia,” “we,” “us,” or “our”) provides an AI-powered fan engagement and immersive technology platform used by enterprise customers such as sports teams, brands, agencies, universities, and venues (“Customers”).

Fiducia acts strictly as a data processor/service provider, supporting the delivery of our platform and enforcing each Customer's privacy policy. We do not act as the data controller, and we do not own, determine, or decide how data is used. All data collected through a customer-branded experience is owned and controlled by that Customer.

2. Fiducia's Role as a Data Processor

Fiducia processes data solely on behalf of Customers, according to their instructions and in compliance with their published privacy policies, contractual agreements, and applicable data protection laws.

Fiducia does not:

  • Sell personal data
  • Use Customer data for its own purposes
  • Combine data between Customers
  • Build internal models using Customer data
  • Override Customer retention, deletion, or consent rules

Fiducia only enforces and technically supports the privacy policy and data handling requirements chosen by each Customer.

3. Data Ownership

All data captured, uploaded, generated, or processed through a Customer-branded Fiducia experience is fully owned by the Customer. This includes, but is not limited to:

  • Fan interactions
  • Images or media submitted by end users
  • AI outputs or analytics
  • Telemetry or engagement data
  • AR interaction logs
  • Player, venue, or event-level data

Fiducia does not maintain ownership, license, or use rights beyond what is required to provide the service.

4. Information We Process

Based on the applicable Customer policy, we may process the following categories of information only as instructed by the Customer.

Personal information

  • Name
  • Email address
  • Phone number
  • Address
  • Team or organization affiliations
  • Other information the Customer collects

Usage data

  • IP address
  • Browser type
  • Device type
  • Pages viewed
  • Time and date of interactions
  • Diagnostic logs

Platform-generated data

  • Image analysis results
  • Engagement metrics
  • Interaction logs
  • AR usage data
  • AI-powered annotations

5. How We Collect Information

Direct collection

Only when a Customer instructs Fiducia to collect information through forms, surveys, fan engagement modules, or experience registration flows.

Automatic collection

This may include cookies, pixels/web beacons, log files, and session tracking tools.

6. How We Use Information

Fiducia processes information only to deliver the platform to Customers, including:

  • Operating and maintaining platform functionality
  • Enforcing the Customer's privacy settings and data use policies
  • Providing Customer support
  • Performing analytics on behalf of the Customer
  • Monitoring performance, detecting fraud, and maintaining security
  • Troubleshooting and debugging
  • Enabling AR, AI, and fan engagement features as configured by the Customer

We do not use Customer data to improve third-party models or for unrelated internal purposes.

7. Data Retention

Fiducia retains data only for as long as instructed by the Customer or required by law. If the Customer instructs deletion of data, Fiducia securely deletes it and verifies completion.

8. Security Measures

We maintain industry-standard technical and organizational safeguards to protect personal data processed on behalf of Customers, including:

  • Encryption in transit and at rest
  • Access control and authentication
  • Network and infrastructure monitoring
  • Secure development practices
  • Redundancy and backup procedures

However, no platform can guarantee 100% security.

9. End-User Privacy Rights

End users may have rights under GDPR, CCPA, or other data protection laws, including access, correction, deletion, restriction, portability, and objection. Because Fiducia is not the data controller, all privacy rights requests must be directed to the Customer who operates the experience. Fiducia will assist the Customer in fulfilling such requests as required.

10. Changes to This Policy

We may update this Privacy Policy periodically. Updates will be posted with a revised “Last Updated” date.
